Terms of Use

Version 2.0 | Effective 16 June 2026

These Terms of Use govern access to and use of the Babeltext messaging systems. As account holders and users, you are subject to these Terms of Use, the Babeltext Privacy Policy, and any disclaimers and notices issued by Babeltext (collectively, the “Terms of Use”). Use of, or access to, the Babeltext messaging service constitutes agreement to these Terms of Use. They replace the version dated May 2023.

Changes to or Termination of Accounts

Babeltext may change any of these Terms of Use at any time by giving notice to the account holder, by email or by posting the change on the Babeltext website once the user is logged in. Continued use of the account amounts to acceptance of the changes. Babeltext may terminate an account if it believes these Terms of Use have been breached or to protect Babeltext property or comply with carrier or legal requirements. Monies owed by the account holder remain payable.

User Responsibilities

Account holders and users must keep their registration information (name, billing details and contact data) accurate, complete and current. Babeltext may verify this information and may terminate, without notice, any account found in non-compliance. Account-holder information is handled in accordance with the Babeltext Privacy Policy.

Use of the Babeltext messaging systems is the account holder’s responsibility and at the account holder’s own risk. To the extent permitted by law, Babeltext (including its employees and contractors) is not liable for any loss or damage caused to the account holder, user or anyone else as a result of using the service, including loss or damage caused by loss or delay of message content, except to the extent caused by Babeltext’s negligence.

Account holders and users are responsible for all costs incurred from using their account, including costs incurred by anyone entrusted with the account holder’s username and password, and accept responsibility for all aspects of their account, including the actions of all persons in possession of those credentials.

The account holder indemnifies Babeltext from all costs, liabilities, suits, actions or claims arising in connection with the account holder’s or user’s use of their account, or any other person using their credentials, except to the extent caused by Babeltext’s negligence.

Account holders and users agree not to transmit any material that violates any law, regulation, regulatory instruction, licence condition or code of practice, or that contravenes any privacy, copyright or other proprietary right; and agree not to harass, stalk, abuse or threaten any person, or interfere with the operation of the Babeltext messaging system, through use of the service.

Message Originator Compliance

The account holder is the message originator and must be aware of and comply with the laws, regulations and carrier requirements applicable to the destination of its messages. Depending on where messages are sent, these include:

Australia

  • the Spam Act 2003 (Cth) — see the ACMA “Spam Act: a practical guide for business”; and
  • the relevant ACMA / Communications Alliance industry codes for commercial SMS.

New Zealand

  • the Unsolicited Electronic Messages Act 2007.

United States

  • the Telephone Consumer Protection Act (TCPA);
  • the CTIA Messaging Principles and Best Practices; and
  • The Campaign Registry (TCR) / A2P 10DLC carrier requirements, including registering the brand and campaign, obtaining valid brand-specific opt-in consent, and supporting STOP and HELP keywords.

United Kingdom

  • the UK GDPR;
  • the Privacy and Electronic Communications Regulations 2003 (PECR); and
  • the Data Protection Act 2018.

Babeltext directors maintain the right to inspect message content and take appropriate action on receiving complaints. Babeltext takes the abuse of people’s privacy rights seriously and will contact account holders about any unsolicited, abusive, deceptive, or misleading messages. Appropriate action may include suspending or cancelling an account pending investigation into alleged abuse or misuse.

All contents of the Babeltext messaging service, including websites, pages, logos, hardware and promotional materials, are protected by copyright and trademarks, remain the property of Babeltext, and may not be copied without permission.

SMS Guidelines for Commercial Message Originators

Across all jurisdictions, three principles apply to every commercial message you send:

A. Consent — only send commercial messages to recipients who have given valid consent (express or inferred where lawfully permitted). In the United States, consent must be a clear, affirmative, brand-specific opt-in and cannot be purchased, shared between brands, or inferred from a pre-existing relationship alone.

B. Identify — include clear and accurate information identifying the person or business responsible for sending the message (a Recognised Identifier that reasonably enables the recipient to identify or contact the originator).

C. Unsubscribe — include a functional opt-out facility (such as replying STOP) in every commercial message, make it easy and low-cost to use, and action opt-out requests promptly. Do not send further marketing messages after an opt-out unless and until the recipient opts in again.

Additional carrier requirements

  • Disclosures — disclose message frequency and that “Message and data rates may apply” at the point of opt-in;
  • Opt-in capture — collect SMS consent through a separate, unchecked, optional action; never bundle it with other consents or bury it in terms;
  • Recordkeeping — keep timestamped records of each opt-in and be able to produce them on request;
  • Keywords — support STOP (opt-out) and HELP (assistance) keywords and respond to them automatically.

Mobile information will not be shared. Babeltext does not share mobile information, SMS opt-in data or consent with third parties or affiliates for marketing or promotional purposes; such data is used only to transmit the messages requested and to meet legal and regulatory obligations. Account holders must apply the same standard to the end-user mobile information they handle.
