Babeltext Pty Ltd (ABN to be inserted) (“Babeltext”, “we”, “us” or “our”) operates a multilingual, omnichannel messaging platform that enables our business customers to communicate with their own end users across channels including SMS, WhatsApp, WeChat, Telegram, Web Chat, Instagram, Discord and Facebook Messenger.
We take your privacy seriously and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, hold, store, disclose and protect personal information, and the rights and choices available to you. It applies to personal information we handle as a data controller in respect of our own business contacts and website visitors, and describes how we act as a data processor / service provider when handling end-user information on behalf of our business customers.
Because we operate internationally, this Policy is designed to meet our obligations under the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles, the UK General Data Protection Regulation (UK GDPR), the Privacy and Electronic Communications Regulations 2003 (PECR) and the Data Protection Act 2018 in the United Kingdom, and applicable United States requirements including the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and The Campaign Registry (TCR) / A2P 10DLC carrier requirements.
We may update this Policy from time to time. The current version is always published on our website, and we recommend you review it periodically. Where changes are material, we will take reasonable steps to notify you.
1. Controller, Processor and Scope
Our role depends on the context in which personal information is handled:
- Where we collect information directly for our own purposes — we determine how and why that information is processed (for example, information about our business contacts, prospects, and website visitors). For this information, we are the data controller.
- Where our business customers use the Babeltext platform to message their own end users — we process that information on their instructions and on their behalf. In that context the business customer is the controller and Babeltext is the processor (and, under US frameworks, the service provider). Our handling of that information is governed by our agreement with the relevant customer.
If you are an end user who has received a message powered by Babeltext and you wish to exercise privacy rights or opt out, you may contact us using the details in Section 12, and we will assist or route your request to the relevant business customer.
2. What Personal Information We Collect
We limit our collection to what is reasonably necessary for the purposes described in this Policy. Depending on your interactions with us, we may collect the following categories of personal information:
- Contact and identity information: name, email address, mobile (cell) telephone number, company name and role, and the content of enquiries you send us.
- Messaging and consent data: where you opt in to receive SMS or other mobile messages, your mobile number, your opt-in record and the date, time, method and wording of the consent you provided.
- Technical and usage information: device ID, device type, approximate geo-location, browser and connection information, page-view statistics, traffic to and from our sites, advertising data, IP address and standard web-log information.
- Customer-directed information: end-user personal information processed through the platform on behalf of, and under the instructions of, our business customers.
- Other information: any other information you choose to provide to us directly, or that we require in order to provide our services.
Only your name, mobile number and email address are mandatory when you submit a general enquiry; you may decline to provide other details. We use Google Ads and Google Analytics to understand aggregate traffic and trends. This does not identify you individually, and we do not export that data outside those tools or share it with unrelated third parties.
3. How We Use Your Information
We use personal information to:
- provide, operate and improve our website, products and services;
- respond to your enquiries and provide support, service, administrative and security communications;
- send you messages you have requested or consented to receive, including SMS where you have opted in;
- perform analytics and research to understand and improve our customers’ experience;
- comply with our legal obligations, resolve disputes and enforce our agreements; and
- where permitted, tell you about other products or services that may interest you, based on your enquiry — subject always to the SMS and marketing consent rules in Section 5.
4. Our Lawful Bases (UK GDPR)
Where the UK GDPR applies, we rely on one or more of the following lawful bases for processing:
- Consent — for direct marketing by SMS or email to individuals, and for non-essential cookies, as required by PECR;
- Performance of a contract — to provide services you have requested and to administer our relationship with you;
- Legitimate interests — to operate, secure and improve our business, where this is not overridden by your interests or rights; and
- Legal obligation — to comply with applicable laws and regulatory obligations.
Where we rely on consent, you may withdraw it at any time without affecting the lawfulness of processing carried out before withdrawal.
5. SMS and Mobile Information — Consent and Sharing
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.
Mobile phone numbers, SMS opt-in data and consent records are never sold, rented, leased, distributed or otherwise shared with third parties or affiliates for their own marketing or promotional purposes. We only use this information to deliver the messaging you have requested or consented to receive, and to meet our legal and regulatory obligations.
How we obtain SMS consent. We (and our business customers) collect SMS opt-in consent through a clear, affirmative action — for example, an unchecked opt-in checkbox on a web form, a keyword text-in, or a point-of-sale sign-up. Consent for text messaging is collected separately from consent for any other channel, and is never bundled with acceptance of terms or other consents.
How you can opt out. You may withdraw your consent and stop receiving messages at any time by replying STOP (or, in the United Kingdom, the applicable opt-out keyword) to any message, or by contacting us using the details in Section 12. Reply HELP for assistance. Message frequency varies, and message and data rates may apply.
Service-related messages. Opting out of promotional messages does not necessarily affect transactional or service-related communications that are necessary to provide a service you have requested.
Sharing with service providers. Where we share mobile numbers with telecommunications carriers, aggregators or messaging sub-processors, we do so only as strictly necessary to transmit the messages you have asked to receive — never for those providers’ own marketing.
6. Who We Share Your Information With
We do not sell your personal information. We may disclose personal information, subject always to the SMS and mobile-information restrictions in Section 5, to:
- our employees, internal contractors and authorised personnel who need it to perform their roles;
- trusted third-party service providers and sub-processors (for example, hosting, telecommunications carriers, messaging aggregators, billing and analytics providers) who act on our instructions under appropriate confidentiality and data-protection obligations;
- the business customer on whose behalf we are processing end-user information;
- a successor entity in connection with a merger, acquisition or transfer of all or part of our assets or business; and
- government agencies, regulatory bodies and law-enforcement agencies where required, authorised or permitted by law.
We do not share any client, or client’s customer, information for unrelated purposes without prior written permission, except where the law requires or permits it.
7. International Data Transfers
Babeltext is based in Australia and uses cloud infrastructure (including Amazon Web Services) and service providers that may store or process information in countries other than your own. Where we transfer personal information internationally — including out of the United Kingdom or the European Economic Area — we put appropriate safeguards in place, such as the UK International Data Transfer Agreement or Addendum, Standard Contractual Clauses, or transfers to jurisdictions recognised as providing adequate protection. You may contact us for more information about these safeguards.
8. Securing Your Information
Our team members are trained to keep your information safe, and we use secure systems and trusted third parties to store it. We apply a range of physical, electronic, administrative, personnel and technical measures to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. We retain personal information only for as long as necessary for the purposes described in this Policy or as required by law, after which we take reasonable steps to destroy or de-identify it. While we work hard to protect your information, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Using Our Website and Cookies
When you use our website we may record certain information about your visit, such as the pages you view, the date and time of your visit and the IP address assigned to your device. We use cookies and similar tracking technologies to remember your preferences and understand website usage. Non-essential cookies (for example, analytics and advertising cookies) are only set with your consent where required by PECR and applicable law, and you can manage your preferences through our cookie banner or your browser settings. Disabling cookies may affect how our website functions. Where a cookie is linked to your account or otherwise identifies you, we treat the associated information as personal information under this Policy.
10. Your Privacy Rights and Choices
Depending on where you live, you may have some or all of the following rights in respect of your personal information:
- to access the personal information we hold about you and request a copy;
- to request correction of inaccurate or incomplete information;
- to request erasure, restriction or objection to certain processing;
- to data portability, where applicable;
- to withdraw consent at any time, including consent to SMS or email marketing; and
- to opt out of direct marketing, and (where applicable under US state laws) to opt out of the “sale” or “sharing” of personal information — noting that we do not sell personal information.
To exercise any of these rights, contact us using the details in Section 12. We may need to verify your identity before responding, and we will respond within the timeframe required by applicable law. Sometimes we may be unable to provide access to all of your information, in which case we will explain why.
11. Making a Complaint
If you have a concern about how we have handled your personal information, please contact us first using the details in Section 12, including your name, email address and/or phone number and a clear description of your complaint. We will acknowledge and respond within a reasonable period.
